As the data controller, Nacon ("We," "Our," "Nacon"), a company of the BigBen group with its headquarters located at 396-466, rue de la Voyette – CRT 2 – 59273 Fretin, collects the personal data of Users and Customers (hereinafter referred to as "Data") from the websites https://www.nacongaming.com/ and https://my.nacongaming.com/ (hereinafter referred to as the Sites). 

Our Privacy Policy aims to inform you about our practices regarding the collection, use, and sharing of the Data you may provide to us through our My Nacon platform (the "Platform") accessible from the Sites or our mobile applications to benefit from the services offered (hereinafter the "Services"). 
Users refer to any internet user who browses one of the Sites and has created an online account on the Platform to become a Nacon Member. 
Subscribers refer to any internet user who signs up for the Sites' newsletter. 
Clients refer to any User who has created an account and places an order on the Sites to purchase a product or subscribe to the Services. 
You should only use the Sites and the Platform after having read our Privacy Policy. If you are a minor, you must register as a member or access the Sites and its Services only after your parents (or your guardian) have read our Privacy Policy. 
Since the processing of your Data is carried out within the framework of Nacon's activities in the territory of the European Union, the General Data Protection Regulation 2016/679 (or "GDPR") applies, whether the processing takes place within the European Union or not. Thus, the processing of your Data is subject to the provisions of the GDPR even if you reside outside the European Union.

Data you provide us with:

• Your email address and your country/region when you register or log into your Nacon member account. If you use a social network account to log in or create a Nacon member account to use Our Services, any publicly available Data (including, but not limited to, your profile picture, gender, date of birth, and language settings) associated with your social network account may also be collected by Us, subject to your consent.

• Your email address when you sign up for the Sites' newsletter.

• The information provided when you fill in your MyNaconGaming profile, namely:

Your last name, first name, username, date of birth, country, language, contact/shipping/billing address (including postal code), contact information, email address.

If you do not provide us with this Data, you will not be able to use the Services.

Data related to your orders that we collect during your purchases on the Sites  (it being specified that to order on the Sites the creation of an account is mandatory):

• Your last name, first name, username, email, postal address, country, language, date of birth, purchase history, registered product(s), and wishlist.

Data related to the use of Services collected by our technical partners  

• Device data: device model, version and type of your operating system, IP address.  

• Log information: such as settings, the time your device is active, the network you use to connect to the Services, availability, crash history, your interface preferences, the type and language settings of your browser, diagnostic and usage data, as well as your usage habits of Our Services.

Recipients of Your Data

To enable NACON to fulfill the purposes stated above, your Data may be sent to the following recipients:

• The companies of the BIGBEN Group (in particular BIGBEN CONNECTED, GAMES.FR, and BIGBEN INTERACTIVE, METRONIC) for the management of the Customer database.

• We transmit your Data once anonymized to Our business partners, including Our business partners providing data analysis services or advertisements and marketing communications based on aggregated and anonymized information.  

Places of Processing of Your Data  

Your Data collected and processed in connection with the Services is primarily stored in the European Union.
NACON is committed to taking all appropriate protective measures in the event of your data being transferred outside the European Union (implementation of the European Commission's standard contractual clauses).  

Data Retention Period  

Your collected data will be retained for the entire duration necessary to achieve the aforementioned purposes, plus the period of the legal statute of limitations.  

The data collected during your registration will be retained for the entire duration of your relationship with NACON. They may then be retained and processed for 3 (three) years from the end of the commercial relationship (for example, from a purchase, the expiration date of a warranty, or the last contact from you) to enable us to send you commercial solicitations, subject to the withdrawal of your consent when it was required or the exercise of your right to object.
  

Your Data may be retained for a longer period due to specific legal obligations or in consideration of applicable statutory limitation periods.

Protection of minors

Each User must provide their age when registering for the Services.
We do not knowingly collect data from minors under fifteen (15) years of age, or an equivalent age according to the regulations in force in their country of residence, without parental consent.   

We encourage parents (or legal guardians) to actively participate in the online activities and interests of minors when they use Our Services.

Nacon will never ask you to provide sensitive Data, such as information about your health status, political views, religious beliefs, criminal record, sexual orientation, sexual life, behavior or genetic information. We therefore thank you for not providing this type of information.  

Deletion of NACON Member Accoun

You may delete your account on the Platform at any time. We draw your attention to the fact that once your account is deleted, you will no longer have access to your history or any information that comprised the account in question.  

Privacy Policy Update   

We may regularly make changes to Our Privacy Policy. We recommend that you regularly review the Privacy Policy posted on the Sites. By accessing or using Our Services after the Privacy Policy has been updated, Nacon will consider that you have acknowledged the terms of the Privacy Policy, including updates. The most recent version of the Privacy Policy will always be available on this page. In the event of a significant change, a notification will be sent to you by email. You can verify the date of modification of the Privacy Policy at the bottom of the page.
